CMS Cancels Biden Effort to Twist the Emergency Medical Treatment and Active Labor Act into an Abortion Mandate
WASHINGTON, D.C. – U.S. Senator Cindy Hyde-Smith (R-Miss.), chair of the Senate Pro-Life Caucus, today issued the following statement regarding the Trump administration’s action to rescind a Biden-era guidance that attempted to establish an abortion mandate within the Emergency Medical Treatment and Active Labor Act (EMTALA). The Centers for Medicare and Medicaid Services announced the decision Tuesday.
“It is so encouraging to have an administration that once again prioritizes the well-being of pregnant women and their doctors. I commend President Trump and Dr. Oz for rescinding the harmful Biden-era guidance that warped EMTALA obligations and created widespread confusion in emergency rooms nationwide.
“EMTALA is a decades-old statute that was originally designed to protect mother-patients and their unborn children in emergency situations, but the Biden administration manipulated the law’s purpose by issuing guidance that forced emergency room doctors to perform abortions, regardless of their states’ life-affirming laws.
“Restoring EMTALA to its original purpose brings much-needed clarity to our incredible emergency room doctors across the country and peace of mind to the patients they serve.”
